1. Provider, scope, and responsibilities
These Terms apply to services offered by XP PLUS America LLC, public business name XP PLUS AMERICA, a company formed in Wyoming, United States, with its support address at 1209 Stringtown Road, Grove City, OH 43123, United States (“XP PLUS," “we," or “us"). They include this Website and any XP PLUS website, web app, or application that expressly refers to these Terms.
Within app.xp.plus, the responsible XP PLUS company is determined by the selected Team's billing profile. The Team-specific Terms displayed there control for that offering.
Responsibilities: XP PLUS is responsible for the platform, user accounts, Badge Cash, payments, XP records, platform security, and XP PLUS service emails. The Team is responsible for the Team content it provides and for selecting, describing, and fulfilling Team-provided Rewards. Additional Reward terms appear on the applicable redemption page.
2. Eligibility and accounts
You must be at least 18 years old to use the full fan services. Registration is free and requires accurate, current information. We may decline registration where permitted by law.
Sign-in may use a time-limited, single-use email link or code or an offered social login. You must protect access to your account, must not allow another person to use it, and must promptly report suspected misuse. Multiple accounts for one Team and attempts to evade restrictions are prohibited.
3. Badges, Badge Cash, and purchases
XP PLUS allows users to acquire and manage digital Badges. A Badge is a limited digital right for use inside the service. It is not a security, crypto asset, transferable property right, or promise of financial return. Badges cannot be sold, transferred, or redeemed for cash outside the service.
Badge Cash is a closed-loop balance usable only for eligible Badge purchases in the identified Team service. It has no cash value outside the service, cannot be transferred, and earns no interest. Prices and any applicable sales tax are shown before checkout is completed.
A Badge display is an invitation to place an order. A contract is formed only after payment succeeds and the order is confirmed. Available payment methods appear at checkout. Any mandatory cancellation, refund, or warranty rights under applicable law remain unaffected.
4. XP Points and Rewards
Valid Badges may earn XP Points under the statistical rules shown when they are acquired. Results may be recalculated after an official sports-data correction. XP Points are not money, cannot be transferred, and cannot be redeemed for cash.
XP Points may be redeemed for available Rewards under the terms shown with the offer. The Team or Reward provider identified on the redemption page is responsible for Team-provided Reward selection, description, availability, and fulfillment.
5. Badge duration and service availability
A Badge remains active for the period shown when acquired, normally the identified game, season, or playoff phase. It cannot earn additional XP Points after that period ends.
We work to keep the services available but do not promise uninterrupted operation. Maintenance, security work, events outside our control, and failures of external sports-data or payment providers may temporarily limit features. We may update or change features while honoring applicable law and active paid rights.
6. Acceptable use
You may use the services only for personal, lawful participation in the intended fan experience. Fraud, money laundering, manipulation of outcomes or XP, unauthorized automated access, circumvention of safeguards, disruption of the service, and content that is illegal or infringes another person's rights are prohibited.
7. Intellectual property and license
The software, designs, marks, text, graphics, Badges, and other XP PLUS content are protected by law. While your account is active, we grant you a limited, personal, nonexclusive, nontransferable, nonsublicensable license to use the services as intended. No other rights are granted.
8. Third-party services
The services may link to payment providers, social-login providers, sports-data services, and Team-operated offerings. Their own terms govern their services. To the extent permitted by law, XP PLUS is not responsible for third-party offerings.
9. Content removal and account restrictions
We may remove content or restrict features when reasonably required for legal, security, technical, or licensing reasons. We may suspend or terminate an account for serious or repeated violations after considering the circumstances. When appropriate, we will give advance notice and an opportunity to respond.
10. Termination
You may stop using free services at any time. We may end free access when no paid interaction can still have an effect. If an active paid interaction can still have an effect, we will terminate only for a serious or repeated violation or another legally permitted cause. Rights that by their nature survive termination remain in effect.
11. Disclaimers and limitation of liability
Mandatory rights and liabilities that cannot legally be excluded remain unaffected. The final US-specific warranty disclaimer, liability cap, exclusions, and any state-specific exceptions will be published only after the remaining XP PLUS America filing details and legal copy are approved. Until then, these Terms do not waive any nonwaivable right or impose an unpublished limitation.
12. Changes
We may update these Terms prospectively for a legitimate reason, including legal, security, or feature changes. We will provide reasonable notice of material changes. If applicable law requires affirmative consent, we will request it before the change applies.
13. Governing law, venue, and contact
The final governing-law and venue provisions will be added after the remaining XP PLUS America filing information and US legal copy are approved. Mandatory consumer rights and any law that cannot be displaced remain unaffected.
